Noctide

1. General Terms

• Noctide (the "platform") is a privately owned service operated by Datadaa OÜ (the "service provider").
• The Service is intended for users aged 16 and older. For users under 16, we require parental or guardian consent.
• By using the platform, you acknowledge that you have read and agree to these terms. If you do not agree, please do not use the platform.

2. Nature of the Service

The platform allows users to:

• add and save dreams and their descriptions;
• receive automated interpretations and emotional analysis using artificial intelligence;
• view dream history, patterns, and changes over time.

The service provider may update the platform's functionality, improve algorithms, or modify the user interface without prior notice.

The service provider is not responsible for any malfunctions, interruptions, or data loss that may occur due to technical reasons.

3. User Rights and Obligations

• You are responsible for all content you enter (dreams, texts, notes).
• You agree not to enter content that is offensive, illegal, or infringes on the rights of third parties.
• You can delete your account at any time directly from the Account view using the "Delete account" action.
• Platform content (including AI interpretations) is intended for self-reflection and does not replace professional psychological counseling.

4. Data Processing and Privacy

• The platform collects and processes data to provide a better experience and analysis.
• All dream texts and metadata are processed confidentially. They are not publicly visible and are not shared with third parties without your consent.
• Anonymous data may be used for statistical purposes without identifying any individual user.
• Your data is not shared with third parties and is never used to train AI models.
• The service provider complies with the General Data Protection Regulation (GDPR) and applicable Estonian data protection laws.

5. Payment Terms

• The platform may offer both a free trial period and paid subscriptions.
• Subscription pricing and duration are displayed on the relevant page of the platform.
• You may cancel your subscription at any time. Payments already made for the current period are non-refundable, except as required by law.
• Payments are processed through secure third-party services. The service provider does not store payment details.

6. Intellectual Property

• All content, design, code, and visuals created on the platform belong to Datadaa OÜ or its partners.
• You retain authorship of your dream texts and submitted content, but grant the service provider a non-exclusive right to process and display them for the purpose of operating the platform.
• AI interpretations and analyses are generated content, the rights to which belong to the service provider.

7. Limitation of Liability

• Noctide provides the service on an "as is" basis.
• The service provider does not guarantee that the platform will operate without interruption, error-free, or be suitable for every purpose.
• The service provider is not liable for direct or indirect damages arising from the use of the service, except as required by law.

8. Changes to Terms

• The service provider has the right to modify these terms.
• Users will be notified of significant changes through the platform or by email.
• Continued use of the service after changes are published constitutes acceptance of the new terms.
